Richard Dyton

 

Richard is a Partner in the Projects Group specialising in infrastructure projects. He leads the Waste Group within the Firm and coordinates the Firm’s PFI/PPP activities. He has extensive experience of advising UK and international sponsor clients together with overseas central and local government. He is consistently recommended as a PFI expert in Legal 500 and Chambers.

 

Recent Experience:

  • Leading a team of lawyers advising on the restructuring of the Channel Tunnel Rail Link Project (capital value
  • £5.3bn) on behalf of Railtrack PLC for which the team was presented the Legal Business Construction Team of the Year award in 1999
  • Advising the Department of Enterprise in Ireland on framework guidelines for Irish rail public private partnerships (IR£3.4bn)
  • Major construction arbitration on behalf of international clients
  • Pathfinder PFI Project in the Netherlands advising on shadow toll road.
     
           

Ann Marie Davies

 

Ann Marie is a Solicitor in the Projects Group at Simmons & Simmons international law firm and has led successful workshops for SMi Group in the past.  Ann Marie specialises in Projects law and waste PFI contracts in particular.  She has extensive knowledge of waste procurement with five years experience working in the sector, advising upon both public and private sector clients.

 

Recent Experience:

  • Advising an energy supplier on a nuclear power plant project.
  • Advising the UK Ministry of Defence in relation to its military flying training scheme.
  • Advised Cheshire County Council on procurement matters and contractual structures in respect of their proposed
  • £1 billion county wide PFI/PPP project.
  • Advised a bidder in relation to Shropshire County Council’s waste PFI contract.
  • Advised Essex County Council and Oxfordshire County Council in relation to their waste PFI contracts.
  • Advised Northamptonshire County Council on it’s £200m grouped schools PFI project.
     
   

Simon Kenolty

 

Simon is an Associate in the Simmons & Simmons Projects Group and is experienced in advising both the public and private sector on commercial and projects work. Simon specialises in projects, particularly in the defence and public authorities sectors. Simon has provided advice and assistance in relation to procurement projects for a number of public authorities, including central government departments and emergency services authorities as well as advising private sector clients on general commercial work.

 

Recent Experience:

  • Transport for London in relation to various elements of its congestion-charging service procurement
  • The UK Ministry of Defence as a secondee. His role includes reviewing and advising in relation to the Department’s major procurements, including PFI projects, providing legal advice in relation to PFI/PPP policy within the Department and revising the Department’s standard form PFI contract
  • The UK Ministry of Defence in relation to various defence procurement projects including elements of the DTR training project and the UK Military Flying Training System
  • A major water and wastewater treatment supplier as an inhouse secondee over a period of 5 months, in relation to numerous PFI and PPP structures covering the tendering, construction and operations phases.
     
    Iain Duncan

 

Iain is a Managing Associate in Simmons & Simmons' Projects Group in London. He has over 8 years of experience advising on transactions around the world in the energy and infrastructure sector. He has provided advice and assistance in relation to PPP/PFI projects and other strategic partnering arrangements, acting for both public authorities (including government departments) and private sector clients.

 

Recent Experience:

  • Advising the MoD in relation to the Defence Training Rationalisation Programme PPP/PFI, one of the largest and most complex defence infrastructure projects ever undertaken by the MoD
  • Advising Network Rail in relation to various contractual matters including, most recently, advising in respect of the infrastructure arrangements relating to the interface between and operation and maintenance of NR’s rail network and the High Speed rail network in the South-East of England
  • Advising Transport for London (TfL) in relation to the London Congestion Charging Scheme, the Western Extension Zone, the London Low Emissions Zone and the Lorry Road User Charging Scheme in connection with strategic, structuring, contractual negotiation and drafting issues in respect of TfL's arrangements with its private sector partners
  • Advising the Energy Technologies Institute (a public-private corporate joint venture, that creates clean energy projects) upon the structuring of its contractual arrangement
     
    Helen Forsey

 

Helen is an Associate in the Simmons & Simmons' Projects Group. She practises all aspects of Projects work, including PFI/PPP and commercial work, with a developing focus on the defence and transport sectors.

  • Advising the UK Ministry of Defence in relation to a £14 billion armed forces training PFI.
  • Advised a bidder in relation to Derbyshire County Council’s waste PFI contract.
  • Advised the project company in relation to a trans-European gas pipeline.
  • Advising HM Prisons Service on the outsourcing of Retail Prison Shops.
  • Advising a railway infrastructure company in relation to complex commercial contracts and re-negotiations.

WHAT IS CPD?

CPD stands for Continuing Professional Development’. It is essentially a philosophy, which maintains that in order to be effective, learning should be organised and structured. The most common definition is:

‘A commitment to structured skills and knowledge enhancement for Personal or Professional competence’

CPD is a common requirement of individual membership with professional bodies and Institutes. Increasingly, employers also expect their staff to undertake regular CPD activities.

Undertaken over a period of time, CPD ensures that educational qualifications do not become obsolete, and allows for best practice and professional standards to be upheld.

CPD can be undertaken through a variety of learning activities including instructor led training courses, seminars and conferences, e:learning modules or structured reading.

CPD AND PROFESSIONAL INSTITUTES

There are approximately 470 institutes in the UK across all industry sectors, with a collective membership of circa 4 million professionals, and they all expect their members to undertake CPD.

For some institutes undertaking CPD is mandatory e.g. accountancy and law, and linked to a licence to practice, for others it’s obligatory. By ensuring that their members undertake CPD, the professional bodies seek to ensure that professional standards, legislative awareness and ethical practices are maintained.

CPD Schemes often run over the period of a year and the institutes generally provide online tools for their members to record and reflect on their CPD activities.

TYPICAL CPD SCHEMES AND RECORDING OF CPD (CPD points and hours)

Professional bodies and Institutes CPD schemes are either structured as ‘Input’ or ‘Output’ based.

‘Input’ based schemes list a precise number of CPD hours that individuals must achieve within a given time period. These schemes can also use different ‘currencies’ such as points, merits, units or credits, where an individual must accumulate the number required. These currencies are usually based on time i.e. 1 CPD point = 1 hour of learning.

‘Output’ based schemes are learner centred. They require individuals to set learning goals that align to professional competencies, or personal development objectives. These schemes also list different ways to achieve the learning goals e.g. training courses, seminars or e:learning, which enables an individual to complete their CPD through their preferred mode of learning.

The majority of Input and Output based schemes actively encourage individuals to seek appropriate CPD activities independently.

As a formal provider of CPD certified activities, SMI Group can provide an indication of the learning benefit gained and the typical completion. However, it is ultimately the responsibility of the delegate to evaluate their learning, and record it correctly in line with their professional body’s or employers requirements.

GLOBAL CPD

Increasingly, international and emerging markets are ‘professionalising’ their workforces and looking to the UK to benchmark educational standards. The undertaking of CPD is now increasingly expected of any individual employed within today’s global marketplace.
