Michael O'Connor - Partner, Infrastructure Projects and Energy

Mike has been a partner with Addleshaw Goddard LLP since 1996 and leads the firm's Infrastructure, Projects and Energy Group. Mike has extensive knowledge of all aspects of PFI projects and has a reputation as one of the leading legal experts on Public/Private Partnerships. He also specialises in financing and leasing transactions generally and Public Private Partnerships and Projects and Infrastructure deals. Mike also advises a wide range of public bodies on procurement strategies and techniques on capital and revenue projects, outsourcing and governance issues. Mike is regarded by the independent commentators for his drafting and knowledge of the PPP market and as an effective closer of deals.

Some notable transactions on which Mike has been involved include:

  • NHS Local Improvement Finance Trust (LIFTs) – advising the public sector on NHS LIFTs at St Helens, Knowsley, Halton, Warrington and Wigan. Also advised the private sector at East Lancashire, Newcastle and Hull.
  • Building Schools for the Future – advising DfES and Partnerships for Schools on the Batching of Secondary Schools - £2.2billion and advising Manchester, Lancashire and Tameside on their BSF programmes.
  • NHS - Advised St Helens and Knowsley Hospitals NHS Trust on its £337 million project and currently advising the Royal Liverpool and Broadgreen University Hospital's Trust on its hospital redevelopment with a value of £500 million.
  • Waste – advised the sponsors on Lancashire PPP Waste £300million and advising senior funders on the £700million Greater Manchester Waste PPP.
  • Strategic Investment Board Northern Ireland - Advising the SIB on its £1bn education initiative to renew the schools estates in Northern Ireland.
  • Advising the joint lead arrangers, NIBC, Bank of Ireland and the European Investment Bank on the £700million Greater Manchester Waste project.
Richard Goodfellow - Partner, Infrastructure Projects and Energy

Richard specialises in energy and utilities work. He has a broad mix of commercial, regulatory and corporate experience, all within the electricity, gas and water projects business. Richard's experience includes:

  • Being client partner and lead advisor to the Northern Ireland Authority for Utility Regulation, the economic regulator for electricity, water and gas in Northern Ireland. Work done to date includes the implications of the Hillyard report on structuring the water industry; work around the Single Electricity Market and enforcement in water and electricity
  • Lead energy specific lawyer on the largest on-shore wind farm deal in England & Wales in 2006, the 65MW Scout Moor wind farm, including work on the power purchase agreement and connection documentation
  • Advising Peel Holdings Group / Dong on the innovative DECC-led carbon capture European Union grant funding competition
  • Lead energy specific lawyer on a bid for a large Round One offshore wind farm development
  • Lead energy lawyer for Peel Utilities on their innovative provisions of water, gas and electricity services at various Peel sitesLead energy specific lawyer on an LNG ship purchase and storage joint venture
  • Lead energy specific lawyer for J Sainsburys in their dealings with Ecotricity
  • Advising the Kelda Group on their (ultimately aborted) mutualisation plan
  • Advising the Strategic Investment Board on their Alpha and Omega PPP projects, including work on customer billing
  • Being client partner for Gaz de France and Smartest Energy in their day to day trading and contractual needs. For example, for Gaz de France, helping to draft standard supply documents and documents with the National Grid and with Smartest, helping them on specific deals (such as a 90MW offshore purchase of energy) and their standard offtake and supply agreements.
  • Day to day energy trading advisor to several clients over a number of years including: Innogy, NPower Yorkshire, NPower Northern, Waste Recycling Group, First Renewables, Smartest Energy which involves drafting GTMAs, post NETA power purchase and sale agreements, electrical response and load management contracts, ROC and CCL contracts including aggregation contracts
  • Reviewing the implications of the Utilities Act and subsequently the Energy Act for an electricity supplier
  • Negotiating on behalf of several renewable generators NFFO power sale contracts amended in light of NETA
  • Advising several clients on the regulatory implications of Independent Energy plc going into receivership and Enron's demise
  • Advising a public electricity supplier on whether to challenge the OFGEM supply and distribution price review
  • Advice on the acquisition of a combined cycle gas turbine power station
  • Advice on the sale of a gas retail supply business
  • Advising EdF in its purchase of London Electricity plc
  • Advising London Electricity plc on its purchase of SWEB's supply division
  • Advising (what was) Ofreg on the Internal Market in Electricity Directive
  • Advising 3 Baltic states on the restructuring of their gas legislation
  • Advising on the investment in and ultimate sale of three chicken litter power stations; one biomass power station and one on shore wind farm.
Gary Sector - Managing Associate, Real Estate

Gary advises on all aspects of town and country planning, highways and compulsory purchase law. He has considerable experience of both Public Inquiry and High Court work.

Gary is currently involved in advising a number of the firm's house builder, retail, waste/utilities and finance house clients in bringing forward large residential, infrastructure and mixed-use schemes, both in London and further a field. Current projects include promotion of waste projects in Surrey and Nottingham and a large mixed use retail/residential scheme in Croydon. He has advised on seven energy from waste projects including Hampshire Waste Service's Chineham, Portsmouth and Marchwood facilities in Hampshire, WRG's Eastcroft in Nottingham (100,000 tpa extension to existing facility), as well as sites for SITA.  He also advised Peel Environmental Limited in successfully obtaining their refuse derived fuel facility consent in 2008 at Ince in Cheshire.  

Gary was the lead associate on the team that gained planning permission for the redevelopment of the Lots Road Power Station in Chelsea on behalf of Hutchison Whampoa. This major mixed-use development led to a 6 week Public Inquiry and detailed negotiation with the Mayor, TfL, English Heritage, the SRA and two London boroughs. Gary also led the planning aspects of the Brighton Marina redevelopment for Brunswick Development Group plc.

Gary regularly writes and gives seminars on all aspects of planning and local government law.

Marnix Elsenaar - Partner

Marnix heads the firm's planning and environment team. His experience includes advising developers, local authorities and urban development corporations on planning issues and compulsory purchase orders for major regeneration schemes. He advises on environmental statements and other planning application documents, negotiates complex section 106 agreements and advises on probity and vires issues. He has advised Peel in connection with its refuse derived fuel facility at Ince in Cheshire and a major utility in connection with the expansion of its LNG facility.

Recent matters include advising the Environment Agency on a number of flood alleviation schemes, National Grid on a number of its redevelopment proposals and Muse on a regeneration scheme in Reading.

  • Advising Hammerson on the planning and compulsory purchase aspects of the Highcross scheme in Leicester City Centre including managing the CPO process and securing confirmation of the Order.
  • Advising Sheffield City Council on the CPO for the New Retail Quarter Scheme in Sheffield City Centre which included negotiating with objectors to the scheme such as Somerfield, advising on all aspects of the CPO process, managing the CPO inquiry and securing confirmation of the Order.
  • Advising National Grid on its planning application for a major residential-led scheme in north London including advice on the design and access statement and environmental impact assessment.
  • Advising London Thames Gateway Development Coroporation on a number of regeneration schemes including the CPO to enable a new Creative Industries Quarter in Barking, east London.

    CPD stands for Continuing Professional Development’. It is essentially a philosophy, which maintains that in order to be effective, learning should be organised and structured. The most common definition is:

    ‘A commitment to structured skills and knowledge enhancement for Personal or Professional competence’

    CPD is a common requirement of individual membership with professional bodies and Institutes. Increasingly, employers also expect their staff to undertake regular CPD activities.

    Undertaken over a period of time, CPD ensures that educational qualifications do not become obsolete, and allows for best practice and professional standards to be upheld.

    CPD can be undertaken through a variety of learning activities including instructor led training courses, seminars and conferences, e:learning modules or structured reading.


    There are approximately 470 institutes in the UK across all industry sectors, with a collective membership of circa 4 million professionals, and they all expect their members to undertake CPD.

    For some institutes undertaking CPD is mandatory e.g. accountancy and law, and linked to a licence to practice, for others it’s obligatory. By ensuring that their members undertake CPD, the professional bodies seek to ensure that professional standards, legislative awareness and ethical practices are maintained.

    CPD Schemes often run over the period of a year and the institutes generally provide online tools for their members to record and reflect on their CPD activities.


    Professional bodies and Institutes CPD schemes are either structured as ‘Input’ or ‘Output’ based.

    ‘Input’ based schemes list a precise number of CPD hours that individuals must achieve within a given time period. These schemes can also use different ‘currencies’ such as points, merits, units or credits, where an individual must accumulate the number required. These currencies are usually based on time i.e. 1 CPD point = 1 hour of learning.

    ‘Output’ based schemes are learner centred. They require individuals to set learning goals that align to professional competencies, or personal development objectives. These schemes also list different ways to achieve the learning goals e.g. training courses, seminars or e:learning, which enables an individual to complete their CPD through their preferred mode of learning.

    The majority of Input and Output based schemes actively encourage individuals to seek appropriate CPD activities independently.

    As a formal provider of CPD certified activities, SMI Group can provide an indication of the learning benefit gained and the typical completion. However, it is ultimately the responsibility of the delegate to evaluate their learning, and record it correctly in line with their professional body’s or employers requirements.


    Increasingly, international and emerging markets are ‘professionalising’ their workforces and looking to the UK to benchmark educational standards. The undertaking of CPD is now increasingly expected of any individual employed within today’s global marketplace.
